The Council of Ministers approved project of law of changing and supplement of the Law of Preserving of Agricultural Land. The project is aimed at updating the existing law that regulates the tendencies of changing the status of agricultural land, with reference to the intensive investment activities. These tendencies developed in the recent decades. The purpose is achieving better balance between preserving the agricultural land and the necessities of development in the investments.

Part of the planned changes include restriction on building or enlarging of facilities referred to producing electric power from renewable sources on land that belongs to category I to IV as well as on areas under irrigation. The aim is to preserve the highly productive agricultural land.                   

The project also includes that altering the status of the land included in categories from I to IV and its change to areas under irrigation, including the cases when building facilities of electric power is necessary, will be carried out on national level, unlike present, when it is carried out on local level.

The status change will be executed by the Commission of Agricultural Land with the purpose of achieving higher degree of protection and control over the procedure. This is the reason why the staff of the commission will include a representative of Ministry of Economy, Energy and Tourism. 

At the same time the project offers that the resolutions of the Commission will lose their legal effect 1 year after issuing the decision for certain area to become construction site or for building up a trace, if during that period no request of changing the status of the land is applied.            

The legal effect of the resolutions of the Commission will also lose their legal effect according to the law also in the cases when the due charge required by the article 30 of the Law of Preserving the Agricultural Land is not paid within 3 months or if within 2 years no permission to start construction activities on the site has been requested. It also applies when within 3 years no construction activities are commenced on the site. These regulations do not apply to construction sites of national and local value.      

The project of the law also defines that the charges due for the changing the status are not refundable if the resolution is revoked, as well as if the resolution loses its legal effect according to the regulations of the law.

This regulation stops the practice of ungrounded change of the status of land. The project increases the fines and penalties in the cases of breaking the law.
